ARTICLE 1 – GENERAL PROVISIONS & ELIGIBILITY

1. Age Requirement: By using this Site, you declare and warrant that you are at least 18 years of age or possess the legal capacity to enter into binding agreements. Persons under the age of 18 are not permitted to make purchases on www.pinarbent.co.uk.
2. Acceptance of Terms: Every order placed on the Site constitutes an implicit acceptance of these Terms & Conditions and the related Distance Sales Agreement.
3. Modifications: We reserve the right to revise, update, or modify these Terms at any time without prior notice. The latest version will always be accessible on this page, and your continued use of the Site following any changes constitutes acceptance of those changes.

ARTICLE 3 – PRODUCTS, ORDERS & PRICING

1. Product Descriptions: We make every effort to display the colors, design features, and details of our haute couture gowns and garments as accurately as possible. However, actual colors may vary slightly depending on your device’s display settings.
2. Pricing: All prices listed on the Site are stated in the indicated currency and include applicable value-added tax (VAT) unless stated otherwise. Shipping fees, customs duties, and import taxes are calculated separately at checkout.
3. Pricing Errors & System Issues: We reserve the right to correct any technical glitches, typographical errors, or pricing mistakes on the Site. In the event of a pricing error or software bug, we reserve the right to cancel any orders placed under erroneous prices and refund the full amount paid without liability.
4. Stock Availability & Order Cancellation: If an ordered product is temporarily out of stock or cannot be fulfilled, we will notify you promptly. With your approval, we may offer an equivalent substitute, allow you to wait for stock replenishment, or issue a full refund and cancel the order.

ARTICLE 4 – PAYMENT TERMS

1. Accepted Payment Methods: Payments can be made via credit card (Visa, MasterCard, American Express, etc.), bank wire transfer/EFT, or cash on delivery where available.
2. Order Authorization: An order is deemed processed when payment is successfully authorized or funds reach our bank account, not at the moment the order is submitted online.
3. Wire Transfer Time Limit: For orders selected with wire transfer/EFT, payment must be completed within 3 (three) business days from the order date. Unpaid orders will be automatically canceled after this period.
4. Credit Card Security: We do not store credit card credentials on our servers. All credit card transactions are transmitted securely via encrypted payment gateways for real-time bank authorization.

ARTICLE 5 – SHIPPING, DELIVERY & CUSTOMS

1. Delivery Scope: Orders are shipped via our contracted international and national courier partners to the address provided during checkout.
2. Delivery Period: Standard delivery is completed within a maximum of 30 business days from the dispatch of the order confirmation email. Under extraordinary conditions, this period may be extended by up to 10 additional business days with prior notification.
3. Import Duties & Customs Taxes: For international shipments, any import duties, tariffs, VAT, or local customs fees levied by the destination country are the sole responsibility of the customer.
4. Damaged Packages: Customers are required to inspect packages upon arrival. If a package appears crushed, torn, or damaged, you must reject delivery and obtain an official Damage Assessment Report (Hasar Tespit Tutanağı) from the courier.

ARTICLE 6 – RETURNS, EXCHANGES & RIGHT OF WITHDRAWAL

1. Return Period: Eligible non-customized products may be returned or exchanged within 3 (three) days of receipt, provided they remain unused, undamaged, in their original packaging, and with all tags attached.
2. Invoice Requirement: Returns must be accompanied by the original invoice with the return declaration signed by the customer.
3. Non-Returnable Items (Custom Tailoring): In accordance with distance trading regulations, custom-made, personalized, or individually altered gowns/clothing cannot be returned or exchanged unless defective.
4. Return Shipping Costs: Unless the product is proven defective or incorrect upon delivery, return shipping charges are to be borne by the buyer.

ARTICLE 7 – INTELLECTUAL PROPERTY RIGHTS

1. All original content, designs, photography, graphics, logos, brand assets, product models, typography, and code published on www.pinarbent.co.uk are the exclusive intellectual property of Pınar Bent Haute Couture and are protected under copyright, trademark, and international intellectual property laws.
2. No portion of this Site may be copied, reproduced, republished, modified, distributed, or commercially exploited without our express prior written permission.

ARTICLE 8 – LIMITATION OF LIABILITY

1. To the fullest extent permitted by applicable law, Pınar Bent Haute Couture shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of your access to, or inability to use, this Site or products purchased through it.
2. We are not responsible for delays or non-performance caused by Force Majeure events (natural disasters, war, strikes, government regulations, or major infrastructure failures).

ARTICLE 9 – GOVERNING LAW & JURISDICTION

1. These Terms & Conditions shall be governed by and construed in accordance with the laws of the Republic of Türkiye.
2. In the event of any disputes arising from these Terms or transactions conducted through the Site, Consumer Arbitration Committees up to statutory monetary limits and the Consumer Courts of Istanbul, Türkiye shall have exclusive jurisdiction.
